This website is owned and operated by Spela Sajovic, o.d.d., Stefetova ulica 14, 4000 Kranj, Slovenia („we“, „us“, or „our“). These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors handmade textile items available for purchase. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
In order to use our website and/or receive our services, you must be at least of the legal age of majority in your jurisdiction, and possess the legal authority, right, and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
Our store is hosted on Wix.com Ltd. They provide us with an online e-commerce platform that allows us to sell our products and services to you.

General conditions

We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to the technical requirements of connecting networks or devices.
You agree not to reproduce, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Key commercial terms

Prices
The prices we charge for our products are listed on the website. Prices quoted do not include the costs of delivery of the products. The costs of delivery of the products will be shown separately on the checkout page and added to the amount payable by you. Prices quoted also do not include import duty and taxes that may apply to orders that are shipped to countries outside the European Union. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.

International orders will be subject to FX translation at the point of sale. We have no control over these charges and cannot predict the translation amount for the cost of goods.
Products
We have made every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colors, features, specifications, and details of the products will be free of errors, and that your computer monitor's display of any color will be accurate.
All orders are subject to acceptance and availability. If we are unable to supply you with the Goods in your order due to matters such as unavailability of stock, materials, key staff, or an Event Outside Our Control or because we have identified a mistake in the description of the Goods or the price stated by us, we will notify you. We will not proceed with the order and will refund any sums you have paid us. If the Goods are temporarily unavailable, we will notify you by email of the date they are expected to be available. You will have the option either to wait until they are available or to cancel your order. If you cancel your order, we will refund any sums you have paid us.
We reserve the right, but are not obligated, to limit the sales of our products to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.
Purchases and payment

When buying an item, you agree that: (i) you are responsible for reading the full item listing before committing to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

You agree to provide current, complete, and accurate account information for all purchases made at our store. You agree to promptly update your account and payment information, including your email address, payment method, and credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. If we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address provided at the time the order was made.
A contract between you and us for the supply of the Goods will come into existence when we send you the Confirmation Notice relating to your order.
A 'Confirmation Notice' means an email that we send to you to confirm that we have dispatched the Goods. A Confirmation Notice will be Our acceptance of the offer made in the order to which that Confirmation Notice relates.
Delivery
The orders are shipped from Slovenia using priority and tracked service. Once your order is dispatched you will be notified via email and will receive a tracking number. Shipping to European countries and the UK may take anywhere from 3 to 6 business days, to the USA from 7 to 10 business days, and the rest of the world from 8 to 14 business days. Shipping transit times are approximate, delays may occur due to external factors or problems with the delivery. We will not be responsible for any delay in delivering the goods if:

1. We have asked you to provide specified information that is necessary for delivering the Goods and you have failed to provide complete and accurate information or you have provided such information later than the date we have asked you to supply it by;
2. Delay or failure is caused by a third party or is wholly or partly caused by an Event Outside Our Control.
Within the European Union, no duties or taxes will apply. Orders that are shipped to countries outside the European Union may be subject to import duty and taxes levied by the destination country, and it is the customer's responsibility to pay for them. Please note that mind the COW cannot control or predict these charges and cannot advise as to what the costs will be, as they vary from country to country. For more information, please contact your local customs office.
Return and refund policy
For unfaulty gloves, simply return them with their included accessories and packaging along with the original receipt within 14 days of the date you receive the product, and we will exchange them or offer a refund based on the original payment method. To be eligible for a refund or exchange, the returned gloves must be clean, unworn, unwashed, and in the same condition that you received them. Before returning the gloves, please write us an email at info@mindthecow.com to let us know if you would prefer a return or an exchange and why your item did not meet your expectations. You must return the gloves at your own risk and your own cost unless we offer to pay the cost of return. In addition, please note that custom-made products are not eligible for a return, unless they are faulty.
Exchange
Subject to stock availability we will endeavor to exchange gloves that are returned to us. In cases where we are unable to provide an exchange, we will first offer a refund. The new gloves will be delivered to you once we have received the returned gloves. Return delivery costs are not refunded but the first replacement gloves will be sent out free of charge.

Returning Damaged Items
Please examine the gloves within a reasonable time after arrival and let us know as soon as reasonably possible if they are faulty, damaged, or not as described. Please contact us and we will assist you further. Once we have confirmed the gloves are faulty, we can exchange them for new gloves or we can process a full refund if requested. We will require you to return the gloves to us. Any gloves displaying damage deemed to be a result of fair wear and tear will not be accepted as faulty.
Refund

We endeavor to process refunds within 10 working days of receipt of the returned goods. Refunds may take up to 14 days to appear in your account. International customs duties and sales taxes are non-refundable for shipments outside of the European Community where they apply.

Errors, inaccuracies and omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or, omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

Submissions

You acknowledge and agree that any questions, comments, suggestions, feedback, or other materials (collectively, 'submissions'), provided by you to us are non-confidential and shall become our sole property. You agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use your in any medium any submissions that you forward to us. You hereby waive all moral rights to any such submissions, and you hereby warrant that any such submissions are original with you or that you have the right to submit such submissions.

Limitation of liability
In no event will we be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Preference of law and dispute resolution

These Terms, the rights and remedies provided hereunder, and any claims and disputes related hereto and/or to the services, shall be governed by, construed under, and enforced in all respects solely and exclusively in accordance with the internal substantive laws of Slovenia, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Ljubljana, Slovenia.
